1. Agreement to Terms
By accessing or using the website, services, or any offerings of Best Friends Health Care Services LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not access or use our website or services.
These Terms constitute a legally binding agreement between you and Best Friends Health Care Services LLC, a limited liability company organized under the laws of the State of Texas. We reserve the right to modify these Terms at any time. Continued use of our services following any modifications constitutes acceptance of the revised Terms.
2. Services Description
Best Friends Health Care Services LLC provides the following services in the greater Houston, Texas metropolitan area:
- Personal Care Services: Non-medical, in-home personal assistance services including grooming, bathing, dressing, meal preparation, mobility assistance, medication reminders, companionship, and related activities of daily living support.
- Non-Medical Transportation: Safe, reliable transportation services for medical appointments, errands, and other approved destinations. This is not an emergency transportation service.
- Professional Cleaning Services: Residential cleaning services including standard cleaning, deep cleaning, and specialized cleaning tasks, available for private pay clients.
All services are subject to availability, staff scheduling, and service area limitations. We reserve the right to decline or discontinue services at our discretion for any lawful reason.
3. Eligibility
You must be at least 18 years of age to use our website or engage our services independently. Individuals under 18 may receive services only with the authorization and consent of a parent or legal guardian. By engaging our services, you represent and warrant that you have the legal authority to enter into this agreement and to make care decisions for the person receiving services, whether that is yourself or a person under your legal guardianship.
4. Scheduling & Cancellation
Cleaning Services: We require at least 24 hours' notice for cancellations of scheduled cleaning appointments. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of up to the full service amount.
Personal Care Services: For ongoing personal care services, we ask for reasonable advance notice of schedule changes. Insurance-funded services may be subject to additional scheduling requirements as specified in your individual care plan.
Transportation Services: Transportation appointments should be scheduled in advance. We request at least 24 hours' notice for cancellations to allow us to serve other clients.
We reserve the right to reschedule or cancel appointments due to weather emergencies, safety concerns, or staff availability. In such cases, we will make every effort to notify you as early as possible and reschedule at a mutually convenient time.
5. Payment Terms
Insurance-Covered Services: For clients with eligible Medicaid managed care coverage, billing is handled directly through HHA Exchange to your insurance provider. You are responsible for any co-payments, deductibles, or services not covered by your plan.
Private Pay Services: Payment is due at the time of service unless alternative payment arrangements have been made in advance. We accept credit cards, debit cards, and checks. Online payments for cleaning services are processed securely through Stripe. Payment plans may be arranged on a case-by-case basis.
Late Payments: Invoices are due upon receipt unless otherwise agreed. Accounts more than 30 days past due may be subject to service suspension. We reserve the right to charge a late fee of 1.5% per month on outstanding balances.
6. Service Area Limitations
Our services are currently available in the greater Houston, Texas metropolitan area. Specific service boundaries may vary by service type. Transportation services may have maximum distance limitations. We reserve the right to decline services outside our established service area.
7. Limitation of Liability
Best Friends Health Care Services LLC is NOT an emergency medical service. In the event of a medical emergency, call 911 immediately.
Our services are non-medical in nature. Our caregivers do not provide medical diagnoses, treatment, or clinical interventions. Medication reminders are provided as a courtesy; we do not administer medications.
To the maximum extent permitted by applicable law, Best Friends Health Care Services LLC, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount paid by you for services during the six (6) months preceding the claim.
8. Client Responsibilities
As a client of Best Friends Health Care Services, you agree to:
- Safe Environment: Maintain a safe, clean, and accessible environment for our caregivers to work in. This includes providing adequate lighting, clear pathways, and secure areas free from hazards.
- Accurate Information: Provide complete, accurate, and current information about care needs, health conditions, allergies, medications, and any changes in condition. Failure to provide accurate information may compromise the quality and safety of care.
- Respectful Treatment: Treat our caregivers and staff with dignity and respect at all times. We maintain a zero-tolerance policy for verbal abuse, physical aggression, harassment, discrimination, or threats directed at our employees. Violations may result in immediate termination of services.
- Insurance Information: Provide current and accurate insurance information. Notify us promptly of any changes to your insurance coverage or eligibility status.
- Pets: Secure any pets that may pose a safety risk to our caregivers during service visits.
9. Termination
Either party may terminate the service relationship at any time with reasonable written or verbal notice. We recommend a minimum of 7 days' notice to allow for an orderly transition of care.
We reserve the right to terminate services immediately and without advance notice in cases involving safety threats to our staff, repeated failure to meet client responsibilities outlined in Section 8, fraud or misrepresentation, or non-payment of services for more than 60 days.
Upon termination, any outstanding balances remain due and payable. We will cooperate in the transition of care to another provider as applicable.
10. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of Best Friends Health Care Services LLC and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works of any content without our prior written consent.
The “Best Friends Health Care Services” name, logo, and all related marks are trademarks of the Company. Unauthorized use of any trademarks is strictly prohibited.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
